DOCUMENT EXPRESS‚Ñ¢ and Document Express Licensor(s), their directors, officers, employees or agents (collectively referred to as Document Express‚Ñ¢) disclaim all warranties, express or implied, including, but no limited to, the implied warranties or merchantability and fitness for a particular purpose. Document Express‚Ñ¢ does not warrant that functions contained in Document Express‚Ñ¢ will meet your requirements, or that operation of Document Express‚Ñ¢ will be uninterrupted or error-free, or that defects in Document Express‚Ñ¢ will be corrected. Furthermore, Document Express‚Ñ¢ does not warrant or make any representations regarding use or results of use of Document Express‚Ñ¢ or related documentation in terms of their correctness, accuracy, reliability, curtness or otherwise. The entire risk as to the results and performance of Document Express‚Ñ¢ is assumed by you. No oral or written information or advice given by Document Express‚Ñ¢ or any Document Express‚Ñ¢ authorized representative shall create a warranty or in any way increase the scope of this warranty. Should Document Express‚Ñ¢ prove defective, you, and not Document Express‚Ñ¢ or an Document Express‚Ñ¢ authorized representative, assume the entire cost of all necessary servicing, repairing or correction. Some states do not allow exclusion of implied warranties, so the above exclusion may not apply to you.
2. Liability limitation
Under no circumstances, including negligence, shall Document Express™ and Document Express™ Licensor(s), their directors, officers, employees or agents (collectively “Document Express™”) be liable for any consequential, incidental or indirect damages (including damages for loss of business information, and the like) arising out of the use or inability to use Document Express™ or related documentation, even if Document Express™ or a Document Express™ authorized representative has been advised of the possibility of such damages. Some states do not allow exclusion of implied warranties, so the above exclusion may not apply to you.
3. Restrictions
You may not, in whole or part, copy, photocopy, reproduce, translate, reverse compile, disassemble, reverse engineer, reduce to any electronic or machine-readable form, or otherwise reduce to a human perceivable form (except for backup copies), the Document Express‚Ñ¢ Software or related documentation without the prior written consent of Document Express‚Ñ¢. You may not change, rent, lease, loan, distribute or create derivative works based upon the Document Express‚Ñ¢ Software in any form, in whole or in part. This prohibition includes transmission of the Document Express‚Ñ¢ Software over a network from one computer to another.
4. Complete Agreement
This license constitutes the entire agreement among the parties regarding the use of the Document Express‚Ñ¢ Software and related documentation. This license agreement replaces and supersedes any prior understandings or agreements, whether oral or written. No contemporaneous understandings or agreements were entered into in conjunction with this license agreement. No change to this licensing agreement will be effective against Document Express‚Ñ¢, unless it is in writing and signed by an authorized representative of Document Express‚Ñ¢.
